This Privacy Policy (“Policy”) describes how Memberwise (“Memberwise”, “we”, “us” or “our”) collects, uses, discloses, and safeguards your personal information when you use the mykinderly.com website (“Website”), the Kinderly web application (“Application”), and any related products and services (collectively, “Services”). By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by this Policy. If you do not agree with the terms of this Policy, please do not use the Services.
Information we collect
Information you provide directly
When you register for an account, enroll a child, or otherwise interact with the Services, we may collect:
- Account information — your name, email address, job title, and organization name.
- Child and family records — child names, dates of birth, health information, emergency contacts, authorized pickup persons, custody arrangements, and other information submitted as part of enrollment packets or center records.
- Payment information — billing address and payment method details. Card numbers are processed directly by our payment processor (Stripe) and are not stored on our servers.
- Communications — messages, support requests, and any other content you send to us.
Information collected automatically
When you use the Services, we automatically collect certain technical information, including:
- Log data — IP address, browser type, operating system, referring URLs, pages viewed, and the date and time of your visit.
- Cookies and similar technologies — we use cookies and similar tracking technologies to maintain session state, remember preferences, and analyze usage. See our Cookie Policy for details.
- Usage data — feature interactions, click patterns, and other analytics data used to improve the Services.
Information from third parties
We may receive information about you from third-party services integrated with the platform, such as authentication providers (Auth0) and state attendance transmission systems (KinderConnect), to the extent necessary to provide the Services.

- Providing and improving the Services — to operate the platform, process enrollments, generate forms, transmit attendance records, and deliver the features you use.
- Account management — to create and maintain your account, authenticate you, and communicate important service updates.

- Customer support — to respond to your inquiries, troubleshoot issues, and provide assistance.
- Analytics and product development — to understand how the Services are used and to improve functionality, performance, and user experience.

Service providers
We share information with third-party vendors and service providers that perform functions on our behalf, including cloud hosting (Cloudflare), payment processing (Stripe), authentication (Auth0), email delivery, and analytics. These providers are contractually obligated to use your information only as directed by us and in a manner consistent with this Policy.
State and regulatory systems
If your center participates in a state subsidy program, attendance and enrollment data may be transmitted to state-designated systems (such as KinderConnect) as required to fulfill your compliance obligations. This transmission is performed at your direction as the account holder.
Legal requirements
We may disclose your information if required to do so by law or in response to valid legal process (such as a subpoena, court order, or government request), or when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, or investigate fraud.
Business transfers
In the event of a merger, acquisition, reorganization, or sale of all or substantially all of our assets, your information may be transferred as part of that transaction. We will notify you via email and/or a prominent notice on the Services before your information becomes subject to a materially different privacy policy.
Data retention
We retain your personal information for as long as your account is active or as necessary to provide the Services. You may request deletion of your account and associated personal data at any time by contacting us at privacy@mykinderly.com. Note that we may retain certain information as required by law or for legitimate business purposes (such as billing records), and that child enrollment records may be subject to retention requirements under applicable state childcare licensing regulations.
Children’s data
The Services are designed to be used by childcare center operators and staff — not by children directly. We collect information about children solely as entered by authorized center staff or parents as part of the enrollment and management process. We do not knowingly collect personal information directly from children under the age of 13. If you believe we have inadvertently collected such information, please contact us immediately at privacy@mykinderly.com.
Operators using the Services to store child records are responsible for complying with applicable laws governing the collection and storage of children’s data, including FERPA and applicable state childcare privacy regulations.
Security
We implement industry-standard technical and organizational measures to protect your information against unauthorized access, alteration, disclosure, or destruction. These measures include encryption in transit (TLS), encryption at rest, access controls, and regular security reviews.
No method of transmission over the Internet or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your information, we cannot guarantee absolute security. In the event of a data breach that affects your personal information, we will notify you as required by applicable law.
Your rights and choices
Depending on your location, you may have the following rights with respect to your personal information:

- Correction — request that we correct inaccurate or incomplete information.
